On February 2, 2010, INEOS ABS (USA) Corporation entered into a Consent Decree with the United States of America and the State of Ohio to resolve outstanding violations of air pollution law. The Consent Decree required the continuation of the air toxic monitoring program that began in 2005 near the INEOS ABS (USA) Corporation facility located in Addyston, Ohio. The Consent Degree has been terminated. INEOS has agreed to continue to partner with the Southwest Ohio Air Quality Agency to operate the air toxic monitoring site after termination of the Consent Degree.
The Kibby Lane location was chosen after consultation with the State of Ohio, the Southwest Ohio Air Quality Agency, INEOS ABS (USA) Corporation, and citizen stakeholders. The first sample collected at this site was taken on August 19, 2012. Samples are collected once every 12 days.
